By accessing and using Estemed ("Platform", "Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Platform Description

2.1 Marketplace Role: Estemed operates as an online marketplace platform connecting patients seeking medical treatments with independent doctors, clinics, and healthcare providers in Azerbaijan.

2.2 Not a Medical Provider: Estemed is NOT a medical provider, healthcare facility, or medical professional. We do not practice medicine, provide medical advice, diagnose conditions, or offer treatment recommendations.

2.3 Platform Services: We provide technology infrastructure to facilitate:

• Browsing doctor profiles and medical procedures
• Requesting treatment quotes from healthcare providers
• Messaging and communication with doctors
• Booking appointments and processing platform fees
• Managing medical treatment inquiries

3. User Accounts and Eligibility

3.1 Account Registration: You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration.

3.2 Age Requirement: You must be at least 18 years old to create an account and use this platform. For minors seeking treatment, a parent or legal guardian must create the account.

3.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Patient Responsibilities

As a patient using our platform, you agree to:

• Provide accurate medical information and history to healthcare providers
• Attend scheduled appointments or cancel with appropriate notice
• Pay all agreed-upon fees for platform services and medical treatments
• Communicate respectfully with healthcare providers and platform staff
• Follow medical advice and treatment plans provided by your chosen healthcare provider
• Report any concerns about medical services directly to the healthcare provider
• Comply with all applicable laws and regulations

5. Healthcare Provider Responsibilities

Healthcare providers using our platform agree to:

• Maintain all required medical licenses and certifications
• Provide accurate information about qualifications, procedures, and pricing
• Deliver medical services in accordance with professional standards
• Maintain appropriate malpractice insurance
• Respond to patient inquiries in a timely manner
• Honor quoted prices and treatment offers made through the platform
• Handle refunds according to stated refund policies
• Maintain patient confidentiality and comply with medical privacy laws

6. Payment Terms

6.1 Platform Fee: Estemed charges a platform booking fee for facilitating connections between patients and healthcare providers. This fee is clearly displayed before payment and is separate from medical service fees.

6.2 Medical Service Payments: Payments for actual medical services are made directly to the healthcare provider, either through the platform or in-person as agreed. Estemed is not responsible for medical service quality or outcomes.

6.3 Payment Processing: All online payments are processed securely through Stripe, a third-party payment processor. Estemed does not store your payment card information.

6.4 Currency: All prices are displayed in the currency specified by the healthcare provider, typically USD, EUR, or AZN (Azerbaijani Manat).

6.5 No Refunds on Platform Fees: Platform booking fees are non-refundable once a treatment offer is confirmed and appointment is scheduled. See our Refund Policy for complete details.

8. Dispute Resolution

8.1 Medical Service Disputes: Disputes regarding medical service quality, outcomes, or medical fees must be resolved directly with the healthcare provider. Estemed is not a party to medical service agreements.

8.2 Platform Disputes: Disputes regarding platform fees, account access, or platform functionality should be directed to [email protected].

8.3 Mediation: We encourage good-faith efforts to resolve disputes through direct communication. If needed, we may facilitate communication between parties.

9. Limitation of Liability

9.1 Platform Liability: Estemed's liability is limited to the platform booking fee paid for the specific transaction in question. We are not liable for:

• Medical outcomes, complications, or adverse events
• Healthcare provider negligence or malpractice
• Accuracy of medical information provided by healthcare providers
• Appointment cancellations or rescheduling by healthcare providers
• Travel arrangements or expenses
• Lost profits, lost data, or consequential damages

9.2 As-Is Service: The platform is provided "as is" without warranties of any kind, express or implied.

10. Intellectual Property

All content on the Estemed platform, including text, graphics, logos, images, and software, is the property of Estemed or its content suppliers and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

11. Prohibited Uses

You agree not to:

• Use the platform for any illegal purpose
• Impersonate any person or entity
• Submit false or misleading information
• Interfere with platform security or operations
• Harvest or collect user information without consent
• Post inappropriate, offensive, or harmful content
• Engage in fraudulent activities

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the platform. You may close your account at any time by contacting [email protected].

13. Modifications to Terms

We may update these Terms of Service periodically. Continued use of the platform after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or platform notification.

14. Governing Law

These Terms of Service are governed by the laws of the Republic of Azerbaijan. Any disputes shall be resolved in the courts of Baku, Azerbaijan.
